GYLA requests termination of the investigation of the case of members of “Georgian dream”

GYLA (Georgian Young Lawyers Association) responded to the fact of the arrest of members of “Georgian dream”.

As the chairperson of GYLA, Tamar Chugoshvili, said on the press-conference held today, they are asking for termination of the investigation into this case and the materials to be forwarded to the State Audit Office.  

“Even in case of confirmation of the actions described in the statement of the Ministry of Internal Affairs by law, it is absolutely inappropriate, disproportional and illegal to discuss criminal liability of the arrested persons, as there was no act, which is determined by the Criminal Code. According to the Criminal Procedure Code, this gives ground for termination of the Criminal investigation/prosecution. Accordingly, we call on the bodies, which are conducting the process, to suspend the investigation of this case and to forward the materials to the State Audit Office for registration”, - Chugoshvili said.  

According to the statement of GYLA, the information spread by the Ministry of Internal Affairs of Georgia, shows that the detained persons: Merab Kachakhidze, Teimuraz Shekhlashvili and Tariel Kardava are not announced guilty for offering/handing material and nonmaterial property to voters, which is the main component of bribing the voters.  

“The materials available for the investigation, indicates only on the illegal membership fees and unlawful donations and do not point to the bribery of voters. Of course, carrying out unlawful membership contributions and donations is an illegal act, but it shell be punished as an administrative violation and not as a criminal offense. It is important the law enforcement agencies to pay special attention to the planning and implementation of the operational activities in a way, which excludes existence of signs of criminal provocation”, - GYLA states.

We will recall you that, yesterday, representatives of Internal Affairs Ministry arrested members of “Georgian dream”: Merab Kachakhidze, Teimuraz Shekhlashvili and Tariel Kardava.
